Accommodation Issues Under the ADA: Dealing with Medical Conditions in a Retail Environment

Most retail employers are familiar with their basic legal obligations under the Americans with Disabilities Act (ADA). But the practical realities that result from managing employees with medical conditions in a retail setting—who face unique scheduling, workload and operational challenges—are often more complex. This program will tackle some of the most common issues retail employers face with regard to employees who need accommodations, including a discussion of leave beyond Family and Medical Leave Act (FMLA), light duty, telecommuting, accommodating pregnancy, returning an employee to work, permissible job and pay changes during periods of accommodation, and more. This program will address what the Equal Employment Opportunity Commission (EEOC) and the courts are expecting of employers in each of these areas, and will provide practical tips and recommendations for retail employers to consider when these situations arise.
